Measurement and data
Quebec Law 25 and your website: consent and cookies
Since September 2023, Quebec's Law 25 has required that any tool able to identify, locate or profile a person be turned off by default. On your website, that affects GA4, advertising pixels and your forms. We set up consent and measurement together, so you comply with the law without losing more data than necessary.

What the law changes
What Law 25 changes on your website
Profiling tools, off by default. Advertising pixels and analytics tools that follow a visitor from one visit to the next wait for that visitor's consent. A consent banner is the usual way to ask for it.
Refusing as easy as accepting. On our site, "Refuse" and "Accept" are the same size and carry the same weight. Consent obtained through a hidden button is hard to defend.
A published privacy policy. It must be written in simple, clear terms. It describes what the site actually does. A tool added to the site is added to the policy the same day.
Forms that say what they do with personal information. This is the most common point where marketing meets the law. Our article Quebec Law 25 and marketing details the three places to check.
Penalties with set amounts. The Commission d'accès à l'information can impose administrative penalties of up to $10 million or 2% of worldwide turnover, whichever is higher.
Google Consent Mode
What Consent Mode recovers, and what it does not
In basic mode, if the visitor refuses, no data is sent to Google, not even the consent status. In advanced mode, Google's tags send cookieless signals, which Google can use to model part of the lost conversions.
This modelling has a threshold: Google sets it at 700 ad clicks over seven days per domain country. Many Quebec SMEs do not reach it. Below that threshold, you manage a budget based on a fraction of your real sales.
The lasting answer does not get around consent: it measures the consent gap and connects your real sales, taken from your management system or your CRM. Our article Consent and measurement: understanding Google Consent Mode's limits gives the details.

Definition
What is Law 25?
Law 25 is the Quebec law that modernized the protection of personal information in the private sector. Adopted in 2021, it came into force in stages through September 2024. On a website, its most visible effects concern cookies and tracking tools, the privacy policy and forms.
This page describes what we install on your site and what the Commission d'accès à l'information publishes. It is not legal advice, and Falia is not a law firm.

Frequently asked questions
Does my website need a cookie banner?+
If your site uses tools that can identify, locate or profile a visitor (advertising pixels, analytics tools that follow them from one visit to the next), Law 25 requires that they be turned off by default. A consent banner is the usual way to ask for consent. Have your situation validated by a legal advisor.
Will I lose data by complying with Law 25?+
Yes, some. Visitors who refuse are no longer tracked as before. Google's advanced Consent Mode and measuring real sales, taken from your CRM or your management system, narrow that gap without getting around the visitor's choice.
Is Google Consent Mode enough?+
No. It passes the visitor's choice to Google's tags only. Other tools (Meta, LinkedIn and the rest) must be blocked until the visitor says yes, through the consent banner or through Google Tag Manager.
Which consent banner should we choose?+
A well-known platform or a custom-built banner, like the one on our site. What matters: refusing as easy as accepting, tools actually blocked before the yes and a correct connection with Google Tag Manager.
Who is responsible if the banner is not compliant?+
Your business. We install and check the technical settings; the legal validation of your situation belongs to your legal advisor.
